Description of Job

The Work Unit:

The Compliance and Enforcement Program of the Air Pollution Control Division (APCD) conducts compliance evaluations (i.e. inspections) and stack test oversight, reviews source submitted reports, provides compliance assistance, provides oversight of local agency contracts, and conducts enforcement actions as appropriate for stationary sources in Colorado. These responsibilities are divided into two functional sections: Compliance Monitoring and Enforcement.

Within the Compliance Monitoring Section, the Emissions Monitoring Unit conducts stack test (to include protocol review, field observations, report review and approval) and emissions monitoring (RATA review, monitor certification, field observations, and EER review) oversight for all stationary sources (including sources in the Oil & Gas sector) in Colorado.

What you will be doing

The purpose of this position is to inspect and evaluate stationary sources that emit air pollutants and determine compliance with State and Federal regulations promulgated by the State Air Quality Control Act through stack testing oversight and emissions monitoring duties. When noncompliance is identified the Division utilizes a variety of options to bring the facility back into compliance to ensure protection of public health and the environment. All work is done under supervision and training.

Job Duties:

Stack Testing and Emissions Monitoring Oversight

Reviews stack test protocols submitted by sources to ensure performance tests are representative of normal operations and meet minimum requirements specified by regulation, permit or Division policies. Requires revisions to protocols that lack minimum data requirements so approved testing is valid and defensible. Oversees performance testing to ensure conformity with the approved protocol and test reference methods. Reviews performance test results and writes stack test memos summarizing operating conditions and test results as applicable. Communicates stack test report review and approval process results to both internal and external customers. When non-compliance is identified, it represents the Division’s interests as a technical specialist to defend allegations in enforcement actions and makes recommendations to supervisors to expeditiously return sources to compliance. Responds to email/phone inquiries (both internal and external) related to test scheduling, conduct, review, and approval.

Participate in Enforcement Actions

Presents findings of fact that support alleged violations, synthesize pertinent information observed or provided during the stack test oversight and/or review of results and communicates facts to supervisors, source representatives, legal counsel, consultants, and industry experts. Assists the supervisors, program managers, and staff in initiating, negotiating, and settling enforcement actions.

Compliance Assistance and Complaint Investigation

Evaluates and synthesizes the information reported, requested, or facts presented by citizens and communicates regulatory applicability, the Division’s procedural process and/or limitations to address internal or external (citizen/stakeholder) air quality related inquiries. Investigates air quality (including odor) complaints to assess potential violations and document activities with inspection reports and/or Division databases. Analyzes information reported, requested, or facts presented by complainants and communicates regulatory applicability, the Division’s procedural process and/or limitations to address citizen air quality related inquiries. When violations are identified, discusses enforcement recommendations with the supervisor and participates as a technical specialist in subsequent enforcement actions. Provides assistance to sources on a variety of topics, including state and federal air regulations, permitting requirements, and air pollution control requirements.

Training and Information Sharing

Requests and participates in training to develop and maintain the skills and technical knowledge necessary to become fully functional as an inspector. Maintains a valid EPA Method 9 certification for Visible Opacity Observations as well as annual olfactory certification from the state. Attends training offered by outside entities such as WESTAR and EPA, as well as internal training, including inspector training for new Division staff. Attends staff meetings to stay informed of Division procedures and to educate and inform co-workers. Provides information and educates sources and general public about the applicable regulations, regulations, and Division procedures regarding air quality matters.

Other Duties as Assigned

Attends meetings, serves on task forces or teams, completes projects, and performs other duties as assigned by the supervisor.

Minimum Qualifications, Substitutions, Conditions of Employment & Appeal Rights

MINIMUM QUALIFICATIONS:

Experience Only:

Four (4) years of relevant experience in Atmospheric Science, Environmental Science, Environmental Engineering, Chemistry, Physics, Mathematics, or Data Analytics. Additionally, stack testing and/or CEMS experience applies towards this requirement

OR

Education and Experience:

A combination of related education and/or relevant experience in Atmospheric Science, Environmental Science, Environmental Engineering, Chemistry, Physics, Mathematics, or Data Analytics equal to four (4) years

PREFERRED QUALIFICATIONS

In addition to the minimum requirements, the successful candidate in this position will have the following experience:

  • Experience interpreting or implementing state and/or federal air quality regulations

  • Experience conducting and/or preparing and/or reviewing stack test reports

  • Experience interpreting or implementing EPA Reference Methods and/or ASTM Methods

  • Experience installing and/or maintaining and/or operating CEMS

  • Experience working with databases

  • Experience providing compliance assistance

  • Experience communicating both orally and in writing to a wide range of partners

  • Excellent oral and written communication skills

  • Excellent interpersonal skills

  • Ability to understand and interpret state and federal air quality regulations

CONDITIONS OF EMPLOYMENT

  • A pre-employment background check will be conducted as part of the selection process.

  • TRAVEL: This position travels statewide to conduct stack testing oversight and investigate complaints. Approximately 60% of time is spent traveling (3 of 5 work days). Must be able to legally operate state vehicles

  • PHYSICAL DEMANDS: Must be able to climb ladders, stairs, and ascend emission stacks. This position is required to ascend (via ladder, stairs, or lift) and perform oversight of testing activities at or near the top of emission stacks ranging in heights from 10 to 200 feet above ground level.
